Pharmacy Portal - Terms of Use

Overview

Pharmacy Portal is provided to you by Seattle Children’s. You can use the Pharmacy Portal to (i) submit a refill request for prescriptions filled by a Seattle Children’s pharmacy; (ii) view the history of prescriptions filled by a Seattle Children’s pharmacy; and (iii) request a refill authorization for a prescription filled by a Seattle Children’s pharmacy.

Accessing Pharmacy Portal

You may use the Pharmacy Portal to access or view prescription information pertaining to you (if you are 18 or older) or another person age 12 or under for whom you are (i) the legal guardian or (ii) the guarantor. The guarantor is the person who is identified in our system as responsible for the patient's bill. You may not permit any other person to access Pharmacy Portal using your user name and password. The security of your password and the use of your account is your responsibility. If you learn or suspect that your user name or password has been wrongfully used or disclosed, you should promptly notify Seattle Children's Pharmacy by telephone at 206-987-2138. Pharmacy Portal is an information management tool only and is for your personal and non-commercial use.
By establishing a login with Pharmacy Portal connection and accessing the account of another person, you are attesting to and warranting that you are the legal guardian or guarantor of that person and that you have the right to access his or her protected health information.

Your Information

The information available for you to view through Pharmacy Portal is not a comprehensive view all of Seattle Children's records relating to your prescription history. You agree that you will not provide, upload, email, post and/or transmit to or through Pharmacy Portal any content that (i) violates these Terms or is unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, offensive, harassing, hateful, embarrassing, pornographic, profane, sexually explicit, or indecent; (ii) constitutes or encourages conduct that would constitute a criminal offense, potentially give rise to civil liability (including claims of defamation and/or libel), or otherwise violates local, state, or federal law; (iii) violates, plagiarizes, or infringes the rights of third parties including, without limitation, copyright, trademark, patent, rights of privacy or publicity, trade secrets, or any other proprietary right; (iv) contains a virus, worm, Trojan horse, or other harmful component; (v) contains any information, software, or other material of a commercial nature; (vi) contains solicitations or advertisements of any kind; or (vii) constitutes or contains false or misleading indications of origin or statements of fact.

Acceptance of Terms of Use

Pharmacy Portal is governed by these Terms of Use (Terms). By using or accessing Pharmacy Portal you agree to be bound by these Terms. Additionally, when using particular Pharmacy Portal functionality, features or services, you may be subject to posted guidelines, rules, and policies applicable to such functionality, features or services that may be posted from time to time (Policies). All such Policies are hereby incorporated by reference into these Terms, and you hereby agree to them.

Changes

Seattle Children's reserves the right at any time to, among other actions, change these Terms, Pharmacy Portal, including eliminating or discontinuing functionality, content and/or features. Any changes Seattle Children's makes to these Terms will be effective immediately upon Seattle Children's posting updated Terms. You agree that by entering, re-entering, or continuing to use Pharmacy Portal thereafter, you accept any and all such changes. Be sure to return to this page periodically to ensure familiarity with the most current version of these Terms.

Privacy

You agree to the terms and conditions of Pharmacy Portal Privacy Policy, which is incorporated into and made part of these Terms. Our treatment of your individually identifiable health information generally, whether or not submitted or accessed by you via Pharmacy Portal, is governed by our Notice of Privacy Practices.

External Links

In order to provide you with greater value, Seattle Children's may provide you with links to various third party Web sites. Seattle Children's exercises no authority over linked sites, each of which may maintain independent privacy and data collection policies and procedures. We do not continuously evaluate, and we are not responsible for, any content on these third-party websites. These destination links are provided only for your convenience. As such, your use of third-party Web sites is governed by any terms of use and/or privacy statements posted on such third-party Web sites, not by our Terms, and you access them at your own risk. The provision of links to third party Web sites or the mention of specific products, processes, or services at Pharmacy Portal does not constitute or imply a recommendation or endorsement by us. Seattle Children's wishes to ensure the integrity of Pharmacy Portal and its destination links. Any comments pertaining to Pharmacy Portal or any sites accessed through Pharmacy Portal links are greatly appreciated.

No Warranties

YOU ACKNOWLEDGE AND AGREE THAT SEATTLE CHILDREN'S DOES NOT REPRESENT Pharmacy Portal AS HAVING THE ABILITY TO DIAGNOSE DISEASE, PRESCRIBE TREATMENT, OR PERFORM ANY OTHER TASKS THAT CONSTITUTE THE PRACTICE OF MEDICINE OR OF OTHER PROFESSIONAL OR ACADEMIC DISCIPLINES. SEATTLE CHILDREN'S MAKES NO REPRESENTATIONS OF ANY KIND ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF Pharmacy Portal Pharmacy Portal IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. SEATTLE CHILDREN'S HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO Pharmacy Portal, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SEATTLE CHILDREN'S WILL NOT BE RESPONSIBLE FOR ANY ERRORS OR OMISSIONS IN Pharmacy Portal. YOU ASSUME ALL RISK FOR SELECTION AND USE OF Pharmacy Portal.

Limitation of Liability

IN NO EVENT SHALL SEATTLE CHILDREN'S BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF Pharmacy Portal OR WITH THE DELAY OR INABILITY TO USE Pharmacy Portal, OR WITH HYPERTEXT OR GRAPHIC LINKS TO THIRD PARTIES, OR FOR ANY BREACH OF SECURITY ASSOCIATED WITH THE TRANSMISSION OF YOUR CONTENT THROUGH Pharmacy Portal, OR FOR ANY INFORMATION OR MATERIALS OBTAINED THROUGH Pharmacy Portal, OR OTHERWISE ARISING OUT OF YOUR USE OR ACCESS TO Pharmacy Portal, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF SEATTLE CHILDREN'S HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES AND EVEN IF SUCH DAMAGES RESULT FROM SEATTLE CHILDREN'S'S NEGLIGENCE OR GROSS NEGLIGENCE. YOU SPECIFICALLY AGREE THAT NEITHER SEATTLE CHILDREN'S NOR ITS AFFILIATES, OFFICERS, TRUSTEES, EMPLOYEES, PROVIDERS, VENDORS, LICENSORS OR AGENTS, OR ANY OF THEIR SUCCESSORS OR ASSIGNS, SHALL HAVE ANY LIABILITY TO YOU FOR ANY REASON OR UNDER ANY THEORY WHATSOEVER, BASED UPON THE INFORMATION PROVIDED ON OR THROUGH Pharmacy Portal AND/OR YOUR ACCESS TO AND/OR USE OF THE SITE. BECAUSE SOME STATES DO NOT PERMIT THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

Exclusive Remedy

Your sole remedy against Seattle Children's in the event of a dispute arising out of these Terms and/or your use of or access to Pharmacy Portal, is to cease your use of Pharmacy Portal.

Indemnification

You agree to indemnify, defend, and hold Seattle Children's (its officers, trustees, employees and agents, licensors and suppliers) harmless from and against all claims, actions or demands, liabilities and settlements, damages, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or related to, or alleged to arise out of or relate to, your use of or access to Pharmacy Portal.

Termination

Seattle Children's may terminate Pharmacy Portal services at any time. Seattle Children's may terminate or suspend your access to Pharmacy Portal and may delete your account, at any time, without providing notice to you.

No Unlawful or Prohibited Use

You may not use Pharmacy Portal for any purpose that is unlawful or prohibited by these Terms. You may not use Pharmacy Portal in any manner which could damage, disable, overburden, or impair Pharmacy Portal or interfere with any other party's use and enjoyment of Pharmacy Portal. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided to you through Pharmacy Portal .

You may give notice to Seattle Children's at any time by letter delivered by first class postage prepaid U.S. mail or overnight courier to the following address:

General

These Terms, together with our Privacy Policy and any Policies (as defined above), are governed by the laws of the State of Washington, as such laws apply to contracts formed within Washington by Washington residents, without regard to its conflict of laws provisions, and form the entire agreement between you and us regarding your use of Pharmacy Portal. You consent to the exclusive jurisdiction and venue of courts in King County, Washington, in all disputes arising out of or relating to these Terms or your use of or access to Pharmacy Portal. Any cause of action or claim you may have with respect to these Terms or your use of or access to Pharmacy Portal must be commenced within one (1) year after the claim or cause of action arises. If we fail to enforce any of these Terms, such failure will not be considered a waiver.
Seattle Children's performance of these Terms is subject to existing laws and legal process, and nothing contained in these Terms is in derogation of Seattle Children's obligation to comply with governmental, court and law enforcement requests or requirements relating to your use of Pharmacy Portal or information provided to or gathered by Seattle Children's with respect to such use. If any part of these Terms is determined to be invalid or unenforceable then the invalid or unenforceable provision shall be superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms shall continue in effect.
Any amendment to these Terms must be in a writing signed by us. These Terms do not confer any rights on any third party. Seattle Children's may assign its rights and duties to any party at any time without notice to you.

Copyright and Trademark Notices

Except for content that you submit to Pharmacy Portal, the content and information you view on Pharmacy Portal is the property of Seattle Children's or our suppliers, and is protected by United States and international copyright laws. You may use this information only for personal use. You may make a single copy of content from Pharmacy Portal for your exclusive, personal use. The compilation of content on Pharmacy Portal is exclusively ours.
